Laws on public notaries adopted

Parliament members of the Assembly of Serbia adopted three laws which enable that public notaries start working as of September 1.

Law on verification of signatures, manuscripts and transcriptions, Law on real estate turnover as well as the Law on court fees have been adopted. The laws become effective September 1, since parliament members decided that there are good reasons for the laws to come into force before the eight day as of their publication in the Official Gazette.

The first public notaries in Serbia will completely take over the responsibility from municipalities and courts for authorization of the contracts on real estate turnover while they will share with the court responsibility for authorization of signatures, transricptions and manusripts in the first six months, until March 2015.

Notary exists in all countries in the region and Serbia is the last one implementing the business.

There are 43 notaries in Belgrade now while there are 51 in other cities in Serbia. Nominations will continue because Serbia should have 371 notaries.

A public notary is a jurist at the position of public trust and on the basis of public authorizations he accepts from parties the statement of will, provides necessary written, legal form and issues adequate documents which are treated as public documents.

The Kingdom of Yugoslavia adopted the Law on public notaries 84 years ago, in 1930. However, the profession did not last for long, nor it rooted itself in all parts of the state and it was cancelled in 1994.
