Siemens stopped the tender for the purchase of trams

The notification about the submitted request for the protection of rights, that is, about the suspension of the procedure, was published on the Public Procurement Portal, but it does not show who filed the complaint. On the other hand, Forbes Serbia sources say that it is not only regarding the aforementioned company from Kragujevac, but several other potential bidders who are dissatisfied with the terms of the tender, which makes the public suspect that the job was to be assigned to a specific, already agreed upon, company - and many already saw the Turkish company Bozankaya as the winner.
Potential bidders expressed objections to the deadline, which, according to them, is too short due to the May Day and Easter holidays and asked for an extension of at least 14 days. Also, one of the objections was that the entire tender documentation was published in the Serbian language, and apart from the aforementioned Siemens, there are no other manufacturers of rail and tram vehicles in Serbia, which leads to the conclusion that this tender has elements of an international nature, and is due to the translation into other languages demanding and specific documentation needs to be extended.
Bidders also complained about the criteria for evaluating bids, demanding that the weightings be changed, more specifically the one concerning the delivery dates. In one of the complaints, beginning with the sentence "as a business entity that intends to participate in the procedure of this public procurement", the complaining party wrote that they consider that the contracting authority, PE GSP Belgrade, by prescribing certain specific conditions in a clear and indisputable way, limited the competition and discriminated against bidders, which violated the principles of the public procurement procedure, namely the principle of ensuring competition and prohibition of discrimination and the principle of equality of business entities of bidders.
