Obligations Featured in Decree on Construction Waste Management – Serbia Regulating This Field for the First Time

According to the announcement of the Government of Serbia, in the past years, there has been a noticeable expansion of construction work and an increased number of construction sites, generating large quantities of waste, which has led to the need to proscribe clear procedures for handling this type of waste, from the moment it is generated to the moment it is taken care of, the final disposal or recycling.
The decree specifies that the producer of construction and demolition waste is obligated to prepare a waste management plan, which features, among other things, the data on the type and the planned quantity of waste which will be generated through construction site activities. The owner of the construction and demolition waste is obligated to secure that hazardous construction waste is first set aside at the construction site and to obtain a report on the examination of the waste generated at the construction site.
The construction and demolition waste is collected into containers or suitable bags, which are firm enough and have a sufficient carrying capacity for the waste which will be collected in them. The owner of the waste is obligated to secure the transport of that waste to the facility for the storage and/or treatment of the waste, complying with the waste management hierarchy.
– The owner of the waste can treat construction and demolition waste on its own or hand over the waste to the operator which owns a permit for the treatment of this type of waste. The costs of the treatment, that is, the reuse and/or disposal of the construction and demolition waste are handled by the owner of the waste – the decree says.
The decree envisages that the mobile facility for the treatment of construction and demolition waste can be established in the location designated for its operations, as well as for the storing of the treated construction and demolition waste in the mobile facility, by the local self-government unit.
– Citizens can bring up to one ton of construction and demolition waste generated in households to the location set up by the local self-government unit – the decree says.
The decree forbids the reuse of waste asphalt in the places where it can come into contact with surface or ground waters, in areas subject to floods, swamps, peatland, river banks or plains subject to flooding and lake edges, in the construction of accesses to bridges and embankments, as well as for the covering of landfills, unless previously treated.
