At the meeting held on Wednesday, October 26, at Holiday Inn Hotel in Belgrade, there was also talk about the Serbian civil code, which has been worked on for years, and Professor Slobodan Perovic presented the draft of this document.
– I believe that this will be an all-encompassing, umbrella regulation, a basis for the entire civil matter modeled after the practice of some other countries, such as Germany – said Predrag Groza, partner at TSG, in his interview for eKapija.
The topic of the second session were international standards in sale of goods and international trade, and the attendees were directly presented with the court practice and the legal framework in Serbia, Croatia, Slovenia, Italy and Germany through conversations with their colleagues-legal practitioners.
– We have opted for the most important countries in the region and the states most present in Serbia in order to examine the details within the European framework. In relation to the contract law, there`s a very important document – the Vienna Convention on Contracts for the International Sale of Goods – which our companies are not that aware of, and which is automatically implemented between the signees, unless explicitly excluded by the contract. It introduces a special regime and standards, which is why we`re trying to raise awareness of the Vienna Connection, which has been in effect since 1980 – Groza explained.
The third part of the conference included a cocktail party celebrating the foundation of the Forum of German and Serbia Jurists. The idea to form such an association appeared in May, after a group of legal practitioners from the two countries determined that there was a real need for such an organization.
– The membership is made up of colleagues from Germany and Serbia, and the aim is to improve the cooperation on areas of legal matters and step up the sharing of experiences in order to present the German law as well as possible in Serbia. As well, we wish to be at disposal of the Serbian legal system when it comes to institutions and legal matters of Germany – explains Igor Samardzic, one of the designers and founders of the Forum and a co-owner of a law office in Germany, for eKapija.
The idea is for the Forum to organize the education or the preparation of certain legal comments on concrete subjects, such as, for example, in the area of labor law, in which Samardzic specializes.
– This is a very interesting topic for Serbia as well, especially in the light of the process of accession to the European Union – our interviewee said.
Igor Samardzic says that it was determined through the cooperation with colleagues from other countries that an increasing number of foreign companies were becoming interested in the Serbian law. One of the reasons is that the presence of German investors in Serbia is considerable.
– The forum has been founded and we are now beginning to define concrete topics. On such occasions, I like to cite Victor Hugo, who once said: “Nothing is as powerful as an idea whose time has come” - Samardzic concluded.
